Vacant Property Registration

To support neighborhood stability and preserve property values, the City of Brentwood requires owners of vacant properties and are subject to housing code violations, per Section 500.220 of the City’s Code of Ordinance to register them with the City.

What Is a Vacant Property?

A property is considered vacant if it is unoccupied for SIX MONTHS, as defined in City Code Ordinance Number 4728, and is not actively being maintained, subject to housing code violations, and are not being marketed for sale, lease, or rent.

Registration Requirements

Property owners must register any building or structure that has been vacant for more than SIX MONTHS [180 consecutive days] and is characterized by violation of the housing code. Registration must be renewed bi-annually until the property is no longer considered vacant and is in compliance with all housing codes.

Owners are required to:

  • Submit a completed Vacant Property Registration Form after a property has been vacant for 6 months and if after investigation a code violation has been found.
  • Within thirty (30) days of the date of notification, the property owner may complete any improvements to the property that may be necessary to remove the property from registration under this Chapter and may request a reinspection of the property and reconsideration of the levy of the registration fee. Upon receipt of a written request for reconsideration of the levy of the registration fee which sets out the reasons claimed by the property owner as to why the registration fee should be waived, the Director may waive levy of the registration fee following timely compliance.    
  • Pay the applicable bi-annual $200 registration fee. If the City abates the property additional fees will be charged.
  • Provide a plan for maintaining the property while it remains vacant 
  • The property owner may choose to appeal the registration to the Municipal Court. Or, the property owner may, within 30 days, make repairs and correct the housing code violations and request reconsideration of the registration. If reconsideration is denied, the owner may appeal to the Municipal Court.

Fees

Registration fees help offset the City’s costs for monitoring and addressing potential safety and code compliance issues associated with vacant properties.

  • Bi-Annual Renewal Fee: $200
  • Additional fees may apply for failure to register or maintain a vacant property in accordance with City ordinances.
